Roxanne Cabanero's Camp Says Perjury Complaint By Vhong Navarro Is A Form Of Harassment

This is what Atty. Virgilio Batalla said about the perjury complaint filed by Vhong Navarro against his client, Roxanne Cabanero.

Roxanne is the second girl who filed a rape complaint against Vhong, next to Deniece Cornejo.

Atty. Batalla explained that it is a form of harassment because the perjury case has no legal and factual basis. It’s very basic in our law that a perjury being heard in the prosecution, if there is already a prima facie. If there is already proceedings in the court.

According to the legal dictionary, a prima facie is, "On the first appearance. A fact presumed to be true unless it is disproved."

Atty. Batalla added, If there is evidence presented before the court, well, perjury will come. In the meantime, there is still no perjury since the case is still not open in the court, unless they already admitted that they will show some evidence in the court.

On Thursday, March 6, Vhong filed a counter-affidavit at Pasig Prosecutor's Office as an answer to Roxanne's rape complaint filed last February 19.

Vhong also filed a perjury complaint against the aspiring beauty queen.

The preliminary investigation of the rape complaint filed by Roxanne against Vhong will be on March 13, Thursday.

Atty. Batalla assured that he and his client, Roxanne will be present at the proceedings. He added that Roxanne is in a safe place right now and he is updating her about all the legal developments about the case.

Atty. Batalla also concluded that the perjury case filed by Vhong Navarro is no other than a result of a desperate move. He said they have already prepared and will answer the counter-affidavit filed by Vhong at the preliminary investigation. He added, he doesn't know why Vhong's camp have filed it early since the supposed proper filing of the counter-affidavit is still on the 13th.

Atty. Batalla concluded that if their camp ever finds that Vhong's counter-affidavit has no merit according to their judgment, they will submit the case for resolution.
